1Introduction and Acceptance of Terms

These Terms of Service ("Terms") govern your use of all products and services provided by Verticius Host ("Verticius Host", "we", "us" or "our"). By creating an account, placing an order, making a payment or using any of our services, you agree to be bound by these Terms and by all policies referenced in them.

If you do not agree with any part of these Terms, you must not purchase or use our services. These Terms form a legally binding agreement between you and Verticius Host.

2Definitions

• Client / You: any individual or organization that registers an account or purchases a service from Verticius Host.
• Services: all hosting products we offer, including but not limited to game servers, VPS, dedicated servers, web hosting, bot hosting and related add-ons.
• Allocated Resources: the CPU, RAM, storage, bandwidth, slots and other limits listed in the plan you purchased.
• Client Area / Panel: the billing area and control panel through which you manage your account and services.

3Account Registration and Eligibility

• You must be at least 18 years old, or have the consent of a parent or legal guardian, to purchase our services.
• You must provide accurate, current and complete information when registering and keep it up to date.
• You are responsible for keeping your login details secure and for all activity that takes place under your account.
• One person may not open multiple accounts to abuse promotions, free trials or discounts.
• Accounts created with false information, stolen identities or fraudulent payment methods will be terminated immediately without refund.

4Payment and Billing

• All services are prepaid. Services are activated only after full payment is received.
• Invoices are generated before each renewal date. It is your responsibility to pay before the due date.
• Services with unpaid invoices may be suspended after the due date. Services that remain unpaid may be terminated, and all data on them permanently deleted.
• Prices may change at any time. Price changes apply from your next billing cycle and will be communicated in advance where possible.
• Chargebacks or payment disputes filed without first contacting our support team will result in immediate suspension of all services on the account. We reserve the right to recover any related fees.

5No Refund Policy

• No refunds are issued for any service, upgrade, add-on, renewal or setup fee, whether the service was used fully, partially or not at all.
• No refunds or credits are given for unused time if you cancel a service before the end of its billing period.
• No refunds are given for services suspended or terminated due to a violation of these Terms.
• By completing a payment, you confirm that you have read and accepted this No Refund Policy.

You may cancel a service at any time from the Client Area to stop future renewals.

6Resource Usage (No Over-Usage)

You must stay within the Allocated Resources of the plan you purchased. Over-usage is not permitted.

• You may not use more CPU, RAM, disk, bandwidth, I/O or player slots than your plan includes, or attempt to bypass panel limits.
• "Unlimited" features, where offered, remain subject to fair use and may not be used in a way that degrades performance for other clients.
• Using our services for cryptocurrency mining, file storage/backup dumps, or any other workload that consumes excessive shared resources is prohibited.
• If your service over-uses resources or affects the stability of the node, we may throttle, restart, suspend or terminate it without prior notice, and without refund.
• If you need more resources, you must upgrade your plan.

7Acceptable Use Policy and Prohibited Activities

The following are also strictly prohibited on our services:

• Port scanning, brute-force attempts, hacking, or unauthorized access to any system or network.
• Hosting or distributing malware, viruses, botnets, stressers/booters or exploit tools.
• Phishing, scam, fraud or spam activities, including bulk unsolicited email.
• Hosting illegal content, pirated or copyright-infringing material, or child sexual abuse material (which will be reported to authorities).
• Content that promotes violence, terrorism, harassment or hate.
• Running open proxies, VPN abuse, or any activity that gets our IP addresses blacklisted.
• Reselling our services without written permission.

Verticius Host alone decides whether an activity violates this policy. Violations may result in suspension or termination without refund.

8Data, Backups and Disclaimer

• We perform weekly automatic backups as a courtesy. These backups are not guaranteed to be complete, current or restorable.
• You are solely responsible for keeping your own regular, off-site backups of all your data, files, databases and configurations.
• Verticius Host is not liable for any data loss, corruption or downtime, whether caused by hardware failure, software issues, attacks, human error or any other reason.
• Backups of terminated or suspended services may be deleted at any time without notice.

9Uptime and Service Availability

• We aim to keep all services online and stable, but we do not guarantee uninterrupted or error-free service.
• Scheduled maintenance will be announced in advance where possible. Emergency maintenance may be carried out without notice.
• Downtime caused by maintenance, attacks, upstream providers, data center issues, or events beyond our control (force majeure) does not entitle you to a refund or compensation.
• Our DDoS protection reduces the impact of attacks but cannot guarantee protection against every attack.

10Suspension and Termination

• Verticius Host may suspend or terminate any service, with or without notice, if you breach these Terms, fail to pay, abuse our staff or infrastructure, or put our network or other clients at risk.
• Serious violations, including DDoS attacks, fraud, chargebacks and illegal content, lead to immediate termination without warning or refund.
• Upon termination, all data on the service may be permanently deleted and cannot be recovered.
• Abusive, threatening or disrespectful behavior toward our staff in tickets, Discord or any other channel may result in termination of your account.

11Limitation of Liability

Services are provided "as is" and "as available". To the maximum extent permitted by law, Verticius Host is not liable for any indirect, incidental or consequential damages, including loss of data, profits, revenue or business. Our total liability for any claim is limited to the amount you paid for the affected service in the previous month.

12Indemnification

You agree to indemnify and hold harmless Verticius Host, its owners and staff from any claims, damages, losses or legal costs arising from your use of our services, your content, or your breach of these Terms.

13Privacy

We collect only the information needed to provide and bill for our services. We do not sell your personal data. We may share information with law enforcement when required by law or when investigating abuse.

14Governing Law

These Terms are governed by the laws of Pakistan. Any dispute will be subject to the exclusive jurisdiction of the courts of Lahore, Pakistan.

15Changes to These Terms

Verticius Host may update these Terms at any time. Changes take effect once published on our website. Continued use of our services after changes are posted means you accept the updated Terms.
